Deposit Agreement
Deposit is not refundable after you have made your choice of pup
All pups come with a Breeders written guarantee of good health, veterinarian's examination, health record card, current vaccinations, and dewormed.
Microchip I.D
All pups come with CKC or AKC limited registeration.
All pups are sold as pets.
In order for us to hold a puppy we require a $500-00 cdn deposit. You can secure your choice of puppy via phone, puppy application or email, the pup you have chosen will be held for a maximum 5 days awaiting prompt deposit payment. We will reserve the pup until he/she reaches 6 weeks of age at that time the final payment is due. Other payment arrangements can be worked out.
We encourage all new owners to visit their pups after about six weeks, by this time they will be vaccinated and ready for play. At eight weeks they are ready to join their new families.
We reserve the right to decline unsuitable homes. You wouldnt give your child to just anyone and this is how we feel about our bullies.
DEPOSIT AND PURCHASE
1. The Purchaser shall pay to the Breeder the amount of $500.00 (the Deposit Amount) by certified cheque, money order, cash or other method of payment approved in writing by the Breeder.
2. Upon receipt of the Deposit Amount the Breeder shall add the Purchaser to the end of a waiting list (the Waiting List) for the Dog.
3. Upon the birth of a litter of Dogs, the Breeder shall contact the persons on the Waiting List in the order in which Deposit Amounts were received to offer such person the right to purchase (a Purchase Offer) one of the Puppies from said litter.
4. Any persons on the Waiting List not receiving a Purchase Offer due to an insufficient number of available Dogs shall be kept on the Waiting List by the Breeder in priority sequence for the next available Dog.
5. Upon acceptance of a Purchase Offer the Breeder will arrange to have the Purchaser select his or her choice of Dog from the available Dogs (the Selection). The Breeder shall allocate choice of Dogs in the same order that persons were selected from the Waiting List.
6. Upon the date on which the Purchaser receives the Dog from the Breeder (the Pick Up Date), or at any point prior to such date, the Purchaser shall pay to the Breeder by cash, certified cheque, money order or other method of payment approved in writing by the Breeder the sum of $$$$$ (the Balance) which together with the Deposit Amount totals $$$$$ (the Purchase Price).
7. If for any reason, before the Purchaser makes a Selection, the Purchaser wishes to remove himself or herself from the Waiting List and forfeit any right to receive either a Purchase Offer or a Dog (a Cancellation), the Breeder shall remove the Purchaser from the Waiting List and return the Deposit Amount to the Purchaser Less a 20% administration fee.
8. If for any reason, after the Purchaser makes a Selection, the Purchaser wishes to make a Cancellation, the Breeder shall remove the Purchaser from the Waiting List, however the Breeder shall keep the Deposit Amount.
9. The Purchaser and the Breeder acknowledge and agree that after the Selection, the Deposit Amount is Non-Refundable and the retention of the Deposit Amount by the Breeder is in satisfaction of liquidated damages suffered by the Breeder and in no way prevents, supersedes, or inhibits any other action for damages or losses that the Breeder may have either at common law or in equity or for any reason whatsoever.
10. The Pick Up Date shall occur upon the Dog attaining an age of approximately eight weeks of age or at any later date as is in the best interests of the Dog, such best interests of the Dog to be determined in the sole and absolute discretion of the Breeder.
11. At any time prior to Pick Up the Breeder may terminate this Agreement, return the Purchase Price to the Purchaser, and refuse to allow the Purchaser to make a Pick Up, if in the sole and exclusive opinion of the Breeder, the Purchaser would provide an unsuitable environment in which to raise the Dog.
